My Ride: Collected Sept 2009 - BMW E90 M3, Silverstone II, Novillo Black leather, 19" M Double-Spoke alloys, High Beam Assist, Electronic Damper Control, Voice Control, PDC, USB, DAB, High Gloss Shadowline, Sliding armrest, Trim Finishing in aluminium grey.

and if they did, is it a retrofit or just a software switch.

As far as I know, it's a software activation. I think early on there were ilegal ssues with specific countries so I can't list each and every scenario but I think the US cars are now activated (and early E60's can be activated via software upgrade.)
One thing I've been waiting for (and have been too busy to do it myself) is for someone to prove this by posting a video of the lights coming on. I wanted to do this during the winter (easier to activate ABS in the snow) but never got a chance.

I've heard from Hobi, if I may quote him, that the brake force tail lights is a software issue and will be fixed with the coming September CIP (software).

The link to the thread which Rudy has mentioned above was created by me. If my cause some confusion initially but in the end the Brake Force Display was finally activated.
Yes it was just a software update. Dealer would obviously have to look in the correct place to do which was update the light module software.
