Is bmw required to inform you of an update?

The last software update I've had was in february or march. I keep seeing post about other owners getting updates recently. Since february I've taken my vehicle in for service twice since then and I have always asked if there was one available. Answer has been no. My question is do dealers have to tell you when there is one available? One other thing I really don't know which version I have.

They only HAVE to tell you (without you asking ) if it is something that affects the safety of the car
Only way to know your version is to plug it into the service computer and seeing what your current software version is.
They should tell you there is a newer one available if you ask, and there is one

My Ride: E61 525iA Build 2004/08. "Safirschwartz Metallic". Navi Pro, Adaptive Headlights, Bi-Xenon, Panorama Sunroof etc... CIP 18.00.01 (No noticed bug)
And there ARE software updates since feb/mar!! I would actually try to find a more competent dealer!

My Ride: 545i; Manual Shifter
In my case I haven't upgraded the CIP since I purchased the car nearly 10 months ago. I'm probably still at 12.xx.
At any rate, I've been very lucky to have a car that isn't "buggy".
My car is due for service in the next 2,000 miles. I wonder if I can tell them NOT to upgrade the CIP.

Well i guess its going to get some type of update. Just got informed that the update will fix the throttle dalay. ( also getting the door seals replaced and rear shelf rattle fixed. ) oh also oil change and brake fluid service.
