Mercedes introduced nano-particle clear coat paint in late 2003--supposedly much more scratch resistant, not sure about chip reduction--here's more info:

Here is my DREADFULL experience with the dealership. First I consulted a reputable lawyer in the area, who seemed to think that I had a case; he also referred me to an "expert" who, not only reviews cars for living, but also has testify several time in court in similar cases. This person has told me that part of my trunk has skillfully been repainted and that I should demand for a new trunk streight from the factory or a monetary compensation; with this I went to the dealership. There I met with the service manager and BMW representative. All claimed that that were no record of repair on the car and that they could not see any differce in colour (of course they were blinded by the sun!) so I left because I was not getting any result. But the fight is not over!! I know that there is a device that mesure the thickness of the paint to see if the car has been repainted. I still have time on my warrenty but I need to built a strong case. BMW are fighters and they have plenty of lawyers at their disposal. As I was told by the "expert" it's hard for a jury to feel sorry for someone who can spend $50000+ on a car, and BMW couns on people getting frustrated and letting go the all thing. My advice: BE AGGRESSIVE, DETERMINED AND PREPARE TO GO ALL THE WAY, DO NOT COMPROMISE!!! They probably offer you to repaint the car which will automaticaly loose some of the value but, by law they have 3 attempts to fix the problem, paintwise it will only make ir worse. DEMAND A NEW PART FROM THE FACTORY!!! Good luck, let me know how it goes.
