Definitely a burgundy or maroon (or Cabernet as sc said) as dark as it is IMO. What does it look like in direct sunlight? Lighter, I'm sure, but how much? Can you get a pic? Thanks.

Great first post to spot this: believe it or not that is now our car - the pictures were taken in front of the BMW at Gwinnett store outside Atlanta - we brought it home on December 22nd. We love the color. There's an M5 in town with the same color.
