it does ound like a warranty issue to me but you may want to post on the m5 section to get more accurate replies.

16g's...................DAYUUUMMM!!! Why wouldn't this be covered under warranty? Was the car abused? I am assuming that is what they will come back and say.

This is a warranty issue that the stealership must honor. Right now the dealership is most likely sticking with the "fact" that your friend drove the living sh*t out of his M and caused the tranny to give out. However, from my experience with the dealerships that I have dealt with for my Z, they have been pretty mod friendly and worked around my mods. With that said, if your friend did really run his M into the ground, there is nothing the dealership will do.

Good luck to your friend and his situation.

Depends how he drove the car... if he beat the crap out of the clutch why would it be covered?

Doesn't really matter one way or the other...

They would have to prove he drove it in the ground. Ultimately it would come to he said, they said. I think that the service center and BMWNA would have a difficult time saying that it was COMPLETELY due to negligence.

My $.02 anyway....

Although some dealers will give the ok....

Most will fight to replace a clutch on a performance car under warranty... The tranny should be covered no questions asked...
