How warm? Fluid should be 40C for level test IIRC.

Not sure of the temp, but it was just warm. the car was level. it was running. I read some post that said to change the shifting solenoid, between 5 and 6 gear if over 3000 rpm , rpm jump up to 4500 to 5000 makes a whining noise and shift real hard, if i keep rpm below 3000 it shift fine.I purchased the 530i about 6 month ago. the first time it happen it would put the car into limp mode. I purchased a code reader and got it out of limp mode and it Has not went back to limp mode but still have problem between the 5 and 6 gear. thanks for the help

Sounds like it was overfilled then. Your transmission appears to be a prime candidate for pan/filter, solenoids and seals, along with fluid change. Others with more direct experience may chime in.
