"CANNOT DUPLICATED THE PROBLEM" need all your opinion on this

I just got my car back from the dealer today and one of the major problems I complained got the same old answer "the problem cannot be duplicated." Thanks to the technology, I was able to record the problem on the films but the dealer still cannot find out what goes wrong and makes the sound.
I noticed this problem since I bought the car in 2008 as CPO. Since the sound is not occurred at all time, I did not make it a big issue but I did complain it from time to time(total 4 times). But every time I got the same answer and problem never fixed.
The sound is coming from the center console(possibly from the engine) when I accelerating over 80mph(RPM over 4000) and usually the outside temp is over 80 degree. The sound then disappeared when I let go off my foot on the gas paddle after the speed drop below 80mph.

Just wondering anyone have similar problem and knows how it can be fixed. I will address this issue to BMW Headquarters and hopefully I can find someone that actually cares about to solve the problem for me.

I dont think a dealer will drive your car over 80mph to troubleshoot an issue. Hence they will never be able to reproduce the problem. Maybe in Germany they could help you...

I have a wind whistle noise that sounds like it's coming through my vent/dash. It first started at 130 mph+, but recently happened at 80+. I took it to the dealer and it couldn't be replicated. I went on M5Board and apparently this is an occassional problem with the windshields. Some aren't perfectly tight and you get a noise like wind is coming through the vents or the dash. Pinpointing it is difficult. The dealer agreed to replace the windshield for me.
