Surely they have insurance for such things. I'd be amazed if they didn't make it right. Good suggestion to get a dealer to look at it right away though so you know the extent of the damage and what you want from them. I would also document what happened and what was said for future reference...just in case.
Like most businesses, they have insurance for stuff like this.

Like most businesses, they have a significant deductible.

Any money paid would be out-of-pocket.

Other than going thru small claims court (if there is one in your state), anyone know how much an attorney would cost?

I estimate about $3600 unless this case takes an inordinate amount of legal time and effort.

Curious.
To answer your question, for a case like this you are looking at between $150 and $300 per hour, depending on the attorney/location. It is impossible to tell how many hours this will take. I disagree with one of the comments that you should never get a lawyer involved unless big money is at stake, but to each his own. If I was going to get a lawyer involved, I would try to see if s/he would be willing to loft a letter over for a set fee and see what happens.

I mentioned this before, but I don't think anyone caught it. If you file a small claims case, its probably going to get dismissed. Why? Because in those form agreements that these companies have, they typically have a clause saying that all disputes will be arbitrated at their option. Now, depending on your state, the small claims court may force mediation/have mediation available, but thats what you are looking at. Thus, as I said above, by the time you pay (1) the filing fee and (2) the cost to serve the complaint, it will probably be cheaper to have the attorney send a letter, which they will respond to.

Took in the car and nothing is wrong, just a major scratch. Thank god but let me tell you I sure learned my lesson and will be either doing this on my own or going to a dedicated tire shop that isn?t full of morons. Thanks for everyone?s input, it was very much appreciated.

That's great news.

Next time, no Jiffy Lube for your machine.

Just to update everyone, I was able to get a hold of Jiffy Lube Corporate and they are sending me a check for the cost of the BMW tech to look at it. So all is well but still no Jiffy Lube every again.

Did you apologize to Jiffy Lube (for jumping to conclusions), or did Jiffy Lube apologize to you (for the initial poor customer service)???

Maybe in today's market, no apologizes anymore.
