Will try to make a long story short.
Love BMW's and their service and professionalism.
During September, my 2004 530i off lease; excited to buy a new E60. Couldn't get accustomed to change on driver's door so I made a deal on the last "NEW" '07 available. 550i
Since deal made and before pickup:
  • Car had miles (295) and safety sticker from Sept. '06.
    Explanation: The other dealer couldn't sell it and most of the miles was put on by the owner's wife; "NO CUSTOMER DROVE IT!" Hmmm, agreed to take car, lady miles and I disliked the new armrest that much.
  • Car left for tinting and update. While waiting, called previous dealer and found out that the car was used for test drives "on a special stretch of road". GRRRR! Essentially lied to, gave the SA the benefit of doubt that he didn't know this.
    Asked for compensation for this new knowledge and I tried to be fair. Asked for tint cost, 5 yr. tire/wheel warranty and some accessories that I was going to buy. Mgr. response: NO WAY!
    Requested my 10k deposit back. Then got: tint (SA complaining that he would have to pay for it), 3 yr warranty (paid $100 more for 5 yr warranty. These guys must be trained to take you for what they can + I guess I'm a bad negotiator) and credit for some accessories.
  • Damage on right front sidewall. We haven't taken the car, yet. Same day as above negotiation.
    Wouldn't change tire, supposedly part of previous agreement. (tire/wheel warranty, tint, credit) Ever heard of a premium dealership sending out a "NEW" car with damage on the sidewall. By this time, tired, just took the car. (Again, Bad negotiator or just a fool!)
  • First full day of ownership, it rained, noticed water droplets along the bottom and side of rt. front light lens.
    At appointment a few days later I was told that it was probably just condensation from a change in temperature. Ok,(only on one side?) but while I'm here, check my suspension 'cause it seems to make a noise and ride is a little rough (thought it was because of the runflats but since I was there anyway...)
    We looked under car and lo and behold, scrapes on undercarriage on the right front, same side as damaged sidewall and watery lens. Unbelievable, but what can I say 4 days after pickup, plus I signed the waiver at purchase that car was ok. Tried to be calm. (Must be nuts, too)
    To top that off, the problem with the noise and ride was that they didn't take off the spacers placed on the suspension when the car is shipped. (Was it on the whole 300mi. driven? Can it damage suspension and computers?) I know it has happend to others, too.
  • AC stunk bad, fixed ok.
  • Car steering jerked to the left during 2 kinda hard braking @ 35mph. Don't know if it was hard enough to activate ABS. Had it occurred with my wife driving, she coulda lost it.
    Resolution: Alignment Note: Informed the RIGHT FRONT is still <1degree off, reassured that "I wouldn't worry about it if it were my car" I haven't even made my first payment to the bank yet and one wheel cannot be completely aligned, the side with the damaged sidewall and moisture in the lens. Did we bang something that nobody is talking about?
  • Still waiting for the black plastic on the door between the front and back windows. Portions faded white, covered with black @ pickup but rain washed it away exposing white. New car, geez?
  • off topic The 21way seat is amazing but after 10 min. my butt sinks into the back panel on the bottom while the middle panel remains firm. Uncomfortable. Told that maybe it's the sport feature to anchor you in. Comments?

I've now had the car for a month and put on 700 miles; total 1000 mi. on odo.

Would appreciate any free legal advice you might want to share.

Not really what to say to this. My opinion, you made a big mistake buying a non-LCI car just because of the armrest. The other improvements, both inside and out, were enough for me to trade my <18 month old 530d for a new LCI 535d. I can only assume you got a REALLY good deal? From the list of problems above, it sounds like you've bought a badly looked after ex-demo / used car. You have not bought a "new" car.

I'm not really sure what kind of reply you are looking for, you've said "any ideas or opinions". My opinion? You shouldn't have bought it! Ideas? If it's not too late to hand it back and buy an LCI, do it. If it is too late, you just have to go through your list of faults and get them _ALL_ fixed. But you have to stop asking why all these problems are there on a "new" car. It's because it is NOT a new car, it's a USED car !

Why would you sign any waivers on a so-called "new" car. This was sold to you as new, not used, so any issues should be on the dealer and with BMWNA. First off, you should have been wondering why the car couldn't sell for over a year. Someone knew something was wrong, and you should have been more hesitant.

I hope you got a good deal, but your dealer should be required to fix ALL problems. I'd give BMW-NA a call and explain what happened. I don't think your SA is going to fix anything for you if you don't. And as for your alignment, if they can't get it into spec, something is damaged!!!

I agree, told you I was nuts. They said after deal made that anything less thatn 500mi they consider new. But, after you go through the deal thinking the baby is safely in storage, when you find out things after the fact you somehow reason/hope it's not so bad. Had I known it had more than 20 miles on it, I wouldn't have given it a look. Represented as new to me, you assume it doesn't have a history. Sort of like you think you married a virgin ... surprise.
Shouldn't they have to disclose whether it his something before you buy.

Paid approximately $1000 over inv. +tax. Not so good looking back. Smelt something, now I guess I pay consequence for stupidity about an armrest.

I think you need to see the dealer owner and/or BMWNA and elevate this situation above your SA. You are not happy and they should be able to assist in either fixing all the problems and concerns, or find an economical way to see you get a new car. There are clearly issues with your car that are somewhat questionable.....this is not a good PR exercise for your dealer or BMW.

I noticed a lot of members 'turn over' their cars frequently. How do you do it, it must cost you. What do you do? Is it best to trade for another or private sale route?

Jesus, what a story, first off the easy part, & congrats...I think

I hope you got a VERY good deal (Sub $60k) on the car because this car is going to be a pain in the ass.

1) I was not broken in properly...it was dawged those 295mls.
2) The car was hit, jumped a curb or something, and damaged the Rt. front...& if the car cannot be aligned, it means something is bent or broken under there.
3) That Rt. light with the water?.....I bet the housing is cracked.
4) Car pulling to one side under hard braking (Not Good) means uneven brake force & could be dangerous, have the give you a printout of the final alignment settings & post it here, so someone can check to see if those settings are typical for that MY 550i. I'm not convinced it's because of alignment.
5) Is this the Car? if yes call Shelly BMW (888-867-9790) and ask around, you might be suprised what you find out.

If the car wasn't titled prior, then it is considered "new," and as such you are entitled to all warranties related to a "new" car and never should have been expected to sign any waivers, etc. You might want to check into if you indeed purchased it as pre-owned or new.

This is definitely going to be escalated if your SA doesn't take care of your wheel, your alignment, your cracked light and everything else damaged on this car. What you got is totally unacceptable, and you won't find any member on here who thinks otherwise. And for $1000 over invoice, you didn't exactly get a great deal considering the issues.

BMWNA for sure!! Get on it on Monday. They won't mess around and will be sure to take care of this issue for you.

Thanks for the welcome and research. Not the car, was on Maui. Pd $60,400 OTD sport package and folddown seats.
