The car has dynamic handling but no active steering. Dynamic handling was gone through and tested (was cool to watch when they did the computer test). It didnt feel like excessive body roll, but, I'm not sure. It definitely cut power as traction control does, that is what made me look down at the cluster to see the traction light flickering.

What about checking the 4 rear subframe rubber bushings for wear?

They said they dropped those to inspect for metal fatigue. He said it was a long shot but apparently some of the E46's had it happen so it was worth looking. They found nothing, so I'm assuming they also checked those while back there.

put your boots on and go around and kick the tires hard. see if any bounce odd. or maybe even jack up each corner and grab and try to wiggle each wheel. it sounds like something is loose.

i wonder if you have a tire with a slipped belt possibly. spin the wheels while jacked up and see if there is any obvious wandering.

Hi, did you ever find out what the problem was? I have the same problem and dynamic drive. Feels like the rear is steering. I suspect worn crossmember bushings.
