I don't think so. There's enough documented evidence (pictures, emails) including the pieces themselves to file for small claims court.

My g/f just went to small claims court last week. She won by default b/c the defendant didn't show up. Even if they had, her case was a slam dunk. I knew she would win, my only concern is collecting what she is owed. From my understanding, the law cannot force the defendant to cough up the money.

So, anyone here with any kind of legal background? I asked a few friends and was told the only recourse for her to collect is to hire a collection agency. The collection agency would take a percentage of what they could get from the defendant.

It looks like my g/f will take it as a lesson in life. You get want you pay for. In her case she went cheap when she used a Chinese moving company to move from DC to LA. They damaged her car and tried to conceal the damage. She's afraid to go after them b/c they're so shady. That they might be somehow involved with the Chinese mafia in LA.

In this case, of tsilveracs vs 2004530i, even if tsilveracs won how would he collect from 2004530i. Hire a collection agency to harass 2004530i 24/7 until he pays up?

I DO think so. There seems to be bugger all evidence of any wrong doing - just general misunderstanding, bluff and bluster ... I hope that the 2 parties will settle their differences like men.
